Consent Management Platform (CMP) and GDPR

What is a CMP?

A CMP is a tool that helps companies comply with the GDPR and other privacy regulations by allowing them to manage and track the consent of individuals for the processing of their personal data. CMPs typically provide a user-friendly interface for individuals to provide their consent, as well as a way for companies to manage and store this consent data.

GDPR, CMPs, and CCPA are all important tools for protecting the privacy of individuals and giving them more control over their personal data. 

  • Companies that operate in the EU or handle the personal data of EU citizens are required to comply with the GDPR 
  • Companies doing business in California are required to comply with the CCPA.

General Data Protection Regulation (GDPR) 

GDPR is a regulation introduced by the European Union (EU) in May 2018, aimed at protecting the privacy of EU citizens and giving them more control over their personal data. It applies to all companies operating within the EU and to companies outside the EU if they process the personal data of EU citizens. The GDPR imposes strict requirements on companies handling personal data, including the need to obtain explicit consent from individuals for the processing of their data, to inform individuals about how their data is being used, and to provide individuals with the right to access, rectify, and erase their data. California Consumer Privacy Act (CCPA) 

CCPA is a privacy law that was introduced in California, United States in January 2020. The CCPA gives California residents the right to know what personal information is being collected about them, the right to request that their personal information be deleted, and the right to opt out of the sale of their personal information. The CCPA applies to companies doing business in California and handling the personal information of California residents.

Why is it important to have a CMP?

Having a CMP ensures your website is compliant with data protection laws, including the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA). CMP vendors provide a code that once implemented collects and manages the consent from visitors to your website. This code protects the privacy of your users and ensures any data collection has the user's consent. The CMP data is used to enrich ad requests and encourage advertisers to bid according to the user consent signal.

How do I get a CMP?

While a lot of CMP vendors exist and allow for seamless implementation, it is important to ensure you are working with  IAB approved CMP vendors and partners.
